Strict rules on audiovisual media services

On 2 October 2018, the European Parliament has adopted new rules on audiovisual media services, protecting the children better, limiting the quantity of advertisements and demands 30% European content at least.

The decision of the Budapest Bar Association of the 1st of October allows the performance of identity verification through videophone

Under the new Act on Attorneys, since January 2018, attorneys at law may countersign documents even if they witnessed the execution of the act of signing or the client’s acknowledgement of the signature as his/her own only through a videophone.

Citizens with no electronic signature are to be able to create electronic documents of full probative value

The newly adopted Code of Civil Proceedings attributes full probative value to the electronic instruments supplied with identity verification-based document authentication.

The identity verification-based document authentication service (in Hungarian: azonosításra visszavezetett dokumentum-hitelesítés, AVDH) offers the possibility of electronic handling of official businesses also for people without an electronic signature. NISZ Zrt. provides the opportunity of AVDH-authentication of .pdf files for every citizen who have client portal (in Hungarian: ügyfélkapu) registration, so that they can create electronic instruments of full probative value for no charge.

Competition Proceeding against Google is closed with Commitment Decision

The Hungarian Competition Authority (Gazdasági Versenyhivatal, GVH) initiated a competition supervision procedure in 2016, to investigate the communications practices of Google LLC (Google) that were assumed to have violated the prohibition of unfair trading practices.

NMHH imposed a fine on Vodafone for infringement in data reconciliation

The official statement of National Media- and Infocommunications Authority (Nemzeti Média- és Hírközlési Hatóság, NMHH) of 27 August 2018 claimed that in 2017, Vodafone did not perform the data reconciliation of about one-third of its subscribers having prepaid phone cards as per the statutory provisions, furthermore, it disconnected unreconciled SIM cards only one week after the deadline. For the above infringement, the media authority decided to impose a fine of HUF 40 million on the telecommunication service provider. Vodafone filed an appeal against the authority’s resolution adopted in June, which was then upheld by the second instance authority on 24 August.

The ruling of the Court of Justice of the European Union states that new permission of the author shall be obtained to the disclosure of the author’s photographs on a website other than that on which they were initially displayed

A press release of the Court of Justice of the European Union on 7 August 2018 disclosed to the public the Court’s judgment, adopted in the proceedings between Land of North Rhine-Westphalia and Dirk Renckhoff, stating that ‘the concept of “communication to the public”, must be interpreted as meaning that it covers the posting on one website of a photograph previously posted, without any restrictions and with the consent of the copyright holder, on another website’. In the opinion of the Court, this communication requires the obtainment of new permission from the author, as it makes the photograph available for a new public.

March 31, 2018 is the payment deadline for the mandatory chamber’s contribution

According to the provisions set forth in Act CXXI of 1999 on economic chambers, business entities are obliged to pay mandatory chamber’s contribution in every year, in the amount of HUF 5000 until March 31 in the current year, i.e. until March 31, 2018 this year.

As of 1 January 2018, all business entities will be obliged to report on holding bank accounts abroad

The new rules amending the Act on the Procedural rules of taxation (Art.), laid down in Act LXXVII of 2017 (which Act is meant to generically amend the various tax laws), will enter into force on 1 January 2018. Such new rules are primarily meant to facilitate an overall whitening of the national economy, as it is stated by the lawmakers.

The Tax Authority’s former General Department in charge of supervising gambling activities has been transformed into a standalone official authority

Pursuant to the relevant government decree entering into force on 6 July 2017, a new official authority has been created, named Gambling Supervisory Authority, to substitute a former department previously operating under the Tax Authority, to perform the tasks related to the mandatory state supervision of the organisation of gambling. The chief officer of such new Authority will be the Chairman of the Authority, while the Authority will be officially supervised by the Minister in charge of the state supervision activities conducted to organise gambling.
